These Terms of Service ("Terms") govern your use of mymiracleleaf.com (the "Site"), operated by Miracle Leaf Franchising, LLC ("Miracle Leaf®," "we," "our," "us"). By accessing or using the Site you agree to these Terms. If you do not agree, do not use the Site.

The Site is Informational Only

The Site provides general information about state medical-marijuana programs (Florida, Georgia, Texas, and other states where Miracle Leaf® clinics operate), about the Miracle Leaf® clinic network, and about how to schedule a physician evaluation. Content on the Site is for general informational purposes only and is not medical advice, not legal advice, and not a substitute for consultation with a qualified professional.

Medical certification for a state medical-marijuana program can only be issued by a state-qualified physician during an in-person or telehealth evaluation at a Miracle Leaf® clinic, in accordance with the applicable state statute. Reading this Site does not create a physician-patient relationship between you and Miracle Leaf® or any clinic operator. A physician-patient relationship is created only at a scheduled evaluation.

Eligibility

You must be at least 18 years old to use the Site. Submitting a contact or appointment-request form represents that you are 18 or older. Minor patients are evaluated only with a parent or legal guardian present, and must follow each state's caregiver registration process.

State medical-marijuana programs have additional eligibility requirements. Submitting a form on the Site does not guarantee that you will qualify for a state program; a state-qualified physician determines qualification based on your medical records, in-person evaluation, and the applicable state statute.

Franchise System Disclosure

Miracle Leaf® clinics are operated by independently owned and operated franchisees of Miracle Leaf Franchising, LLC. Information on the Site about a specific clinic is provided by the franchisor; the clinic visit and certification services are provided by the local franchisee and its physicians. The franchisor is not responsible for the day-to-day operation of any particular clinic.

Acceptable Use

You agree not to:

• Use the Site for any unlawful purpose, or in violation of any applicable law or regulation.
• Submit false, misleading, or impersonated information through a contact or appointment-request form.
• Use the Site to harvest contact information, scrape content, or interfere with the Site's operation.
• Attempt to gain unauthorized access to the Site, our servers, our CRM, or any related system.
• Upload malware, run automated scripts against the Site without permission, or otherwise compromise the integrity of the Site.

Intellectual Property

The Site, including all text, graphics, logos, photographs, icons, images, audio, video, and software, is owned by or licensed to Miracle Leaf Franchising, LLC and is protected by United States and international copyright, trademark, and other intellectual-property laws.

"Miracle Leaf®" is a registered trademark of Miracle Leaf Franchising, LLC. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on the Site, except as expressly permitted in writing by Miracle Leaf®.

User Submissions

When you submit a form on the Site, you grant Miracle Leaf® and the selected clinic a non-exclusive, royalty-free license to use the submitted information to respond to your inquiry, schedule and conduct your appointment, and follow up after your visit. Use of personal information is governed by our Privacy Policy.

We do not solicit, and you should not submit, sensitive personal information (including detailed medical history, social security number, financial-account information, or government-issued identification numbers) through the public contact or appointment-request forms. Bring sensitive documentation to your evaluation in person.

Third-Party Links and Services

The Site may link to third-party websites or display content embedded from third parties (including but not limited to Google Maps, the Florida Office of Medical Marijuana Use registry, the Georgia Medical Cannabis Commission, the Texas Compassionate Use Program, and physician-licensure verification portals). We do not control and are not responsible for the content, privacy practices, or availability of third-party sites.

Pricing and Promotional Information

Clinic fees and state program fees displayed on the Site are accurate as of the page's "Last verified" date and are subject to change. State registry fees are set by each state and may be updated by the state without notice. Confirm current pricing with the clinic at the time of your appointment.

Medical, Legal, and Other Disclaimers

THE SITE AND ALL CONTENT ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF INFORMATION.

Statements on the Site regarding the use, effect, or therapeutic value of cannabis or any cannabinoid have not been evaluated by the U.S. Food and Drug Administration. Federal law continues to classify marijuana as a Schedule I controlled substance under the Controlled Substances Act. Information on the Site is not intended to diagnose, treat, cure, or prevent any disease.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MIRACLE LEAF FRANCHISING, LLC, ITS AFFILIATES, FRANCHISEES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you in full.

Indemnification

You agree to defend, indemnify, and hold harmless Miracle Leaf Franchising, LLC, its affiliates, franchisees, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your misuse of the Site.

Governing Law and Venue

These Terms and any dispute arising out of or related to the Site or these Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws principles. Exclusive venue for any dispute lies in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts.

Dispute Resolution

Option A (mandatory arbitration with class waiver): Any dispute arising out of or related to these Terms or the Site will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and Miracle Leaf® waive the right to bring or participate in a class action, collective action, or representative action.

Option B (court venue, no arbitration): Disputes will be resolved exclusively in the courts identified in the Governing Law and Venue section above.

Counsel should confirm whether mandatory arbitration is desirable given the patient-facing nature of the Site and the YMYL subject matter.

Modifications to the Terms

We may revise these Terms at any time. Material changes will be posted on this page with a new "Last Updated" date. Continued use of the Site after the effective date of a revised version constitutes acceptance.

Severability

If any provision of these Terms is held invalid or unenforceable, the remaining provisions will continue in full force and effect.

Entire Agreement

These Terms, together with the Privacy Policy and any other notices and policies referenced on the Site, constitute the entire agreement between you and Miracle Leaf® concerning the Site.
