After HB 46 of the 89th Legislature expanded the program from 3 licenses to 15, two phases of new selections were announced: Phase I on December 1, 2025 (9 conditional licensees) and Phase II on April 1, 2026 (3 conditional licensees). Who are the 3 active TCUP dispensing organizations in Texas?

Three dispensing organizations are operationally active under the Texas Compassionate Use Program as of May 2026. Each holds a full TCUP license and is authorized to fill prescriptions entered into the Compassionate Use Registry of Texas. Patients can select any of the three to fill a Texas TCUP prescription.

Who are the 9 Phase I conditional licensees?

The Phase I expansion under HB 46 was announced by Texas DPS on December 1, 2025. Nine conditional licensees were selected from the application pool. Per DPS: "Conditional licenses do not grant the applicant permission to cultivate, manufacture, distribute or sell cannabis products until final approval by the department." None of the Phase I licensees are currently authorized to dispense.

Who are the 3 Phase II conditional licensees?

Texas DPS announced the Phase II selections on April 1, 2026, completing the HB 46 target of 12 new licenses. Like Phase I, these three are conditional licensees and cannot dispense until DPS grants final approval. Per the DPS announcement: "The announcement of these three businesses today does not guarantee that these businesses will be issued final TCUP licenses to operate as dispensing organizations."

What does conditional versus active mean for patients?

Only the 3 active dispensing organizations can fill a TCUP prescription today. The 12 conditional licensees from Phase I and Phase II hold pre-authorization from DPS but have not received final approval. Texas DPS has not announced operational dates for the new licensees. Conditional-to-final timing depends on facility build-out, inspection, and DPS due-diligence completion for each licensee individually.

A patient with a current Compassionate Use Registry of Texas prescription should select from the 3 active organizations: Fluent, Texas Original, or Goodblend. Each operates statewide pickup and delivery routes. A storefront marketed as a recreational dispensary in Texas is operating outside the state-licensing framework. The April 2026 federal Schedule III rescheduling did not modify Texas state criminal law.
