The Statute Says Telehealth, In Those Words

Plenty of states make you assemble a telehealth answer from medical board opinions and agency FAQs. Maine does not. 22 M.R.S. section 2423-B states that a medical provider who provides written certifications for the medical use of cannabis may use telehealth services to consult with a patient, and that the provider shall engage in a synchronous encounter before providing a written certification or renewal of a written certification. Initial and renewal certifications sit in the same sentence with the same authorization, which is about as clean as cannabis telehealth law gets.

The one condition baked into that statute matters: the encounter must be synchronous, meaning a real-time interactive audio or video connection as defined in section 2422. Any Condition Your Provider Deems Appropriate

Maine dropped its enumerated qualifying-condition list in 2018. Since then, a Maine-licensed physician, nurse practitioner, or physician assistant may certify any condition for which they determine cannabis may provide therapeutic or palliative benefit, inside a bona fide provider-patient relationship and after a full assessment of your medical history. Older lists of Maine conditions you find online are historical examples, not gates. If chronic pain, PTSD, insomnia, or anything else genuinely affects your life, the conversation with the provider is the whole test.

No Mandatory Registry, No State Fee for Adults

Maine also removed the mandatory adult patient registry in 2018. The written certification your provider issues, paired with a government ID, is sufficient documentation at Maine's medical caregivers and dispensaries. Adults who want a physical program card can enroll in the optional registry at no state fee, and minors must enroll. Practically, that means your cost is the provider visit and nothing on the state side, and there is no waiting period between certification and your first purchase.

Once certified, patients may purchase from licensed Maine medical caregiver storefronts and registered dispensaries, with a 30-day supply of up to 2.5 ounces of harvested cannabis and a medical cultivation allowance of up to six mature plants for patients who prefer to grow. Those allowances run more generous than Maine's adult-use limits, which is a real part of why the certification keeps its value in a state with recreational retail.

Renewing Each Year

Certifications carry their issue and expiration dates and run one year. Renewal means another synchronous encounter, and the statute extends the identical telehealth authorization to renewals, so returning patients simply book another video visit.
