What is the Texas Compassionate Use Program (TCUP)?

Established in 2015 and expanded in subsequent years, TCUP allows qualifying patients to access low-THC cannabis for specific medical conditions. It's important to note:

  • Low-THC Focus: TCUP permits only "low-THC" cannabis, defined by Texas law as containing no more than 1% Tetrahydrocannabinol (THC) by dry weight. This is significantly lower than THC levels often found in medical or recreational marijuana programs in other states. Products typically also contain Cannabidiol (CBD).
  • No "Medical Marijuana Cards": Texas does not issue physical medical marijuana cards. Instead, qualified physicians enter prescriptions into a secure state database called the Compassionate Use Registry of Texas (CURT).
  • Prescription Required: Access requires a valid prescription from a TCUP-registered physician.

Licensed Dispensaries: Prescriptions can only be filled at state-licensed dispensaries.

Qualifying Conditions for Mental Health and Medical Marijuana in Texas

This is a key area where Texas law is very specific. As of early 2025, the primary mental health condition explicitly listed as qualifying for TCUP is:

  • Post-Traumatic Stress Disorder (PTSD): PTSD was added as a qualifying condition in 2021. Texans diagnosed with PTSD by a qualified physician may be eligible for a low-THC cannabis prescription through TCUP.

How Might Low-THC Cannabis Help PTSD Symptoms (Under TCUP)?

For eligible PTSD patients in Texas, low-THC cannabis prescribed under TCUP may help manage certain symptoms. General research suggests cannabinoids might potentially:

  • Reduce anxiety and hypervigilance
  • Improve sleep quality, possibly reducing nightmares
  • Decrease the frequency or intensity of flashbacks
  • Help regulate mood

WHAT ABOUT ANXIETY AND DEPRESSION?

Currently, generalized anxiety disorders and depression are NOT listed as standalone qualifying conditions under the Texas Compassionate Use Program.

While some research suggests cannabis may help with symptoms related to these conditions, you cannot obtain a legal medical marijuana prescription solely for anxiety or depression in Texas under the current rules.

Important Nuance: Some TCUP-registered physicians might consider prescribing low-THC cannabis if anxiety or depression are significant symptoms of another qualifying condition (like cancer or an incurable neurodegenerative disease). However, eligibility always depends on having one of the officially listed conditions and a physician's determination that the benefits outweigh the risks.

How to Get a Medical Marijuana Prescription in Texas (The TCUP Process)

If you believe you have PTSD or another qualifying condition and would like to learn more about mental health and medical marijuana, here are the steps to access medical cannabis legally in Texas:

  1. Confirm Texas Residency: You must be a permanent resident of Texas.
  2. Have a Qualifying Condition: You need a diagnosis for one of the conditions listed under TCUP (like PTSD). Medical records confirming the diagnosis are usually required.
  3. Find a TCUP-Registered Physician: Only specific doctors registered with CURT can prescribe low-THC cannabis. Your regular doctor may not be registered. You can search for registered physicians on the Texas Department of Public Safety (DPS) website or connect with specialized medical cannabis clinics (many offer telehealth services across Texas).
  4. Physician Consultation & Evaluation: Schedule an appointment with a registered physician. They will review your medical history, confirm your qualifying condition, and determine if the potential benefits of low-THC cannabis outweigh the risks for you.
  5. Prescription Entered into CURT: If the physician approves you for treatment, they will enter your prescription details (dosage, allowed amount, type of product) directly into the secure CURT system. You will not receive a physical card.

Purchase at a Licensed Dispensary: Once your prescription is active in CURT, you can visit any licensed Texas dispensary. You will need to provide your valid photo ID. The dispensary staff will verify your prescription in the CURT system before dispensing your prescribed low-THC cannabis product. Minors require a legal guardian to pick up the prescription.
